@GLFOP@FOPNATIONALNATIONAL FRATERNAL ORDER OF POLICEANNOUNCEMENTSThe FOP was disappointed with this week’s announcement thatCongressional leaders working on police reform have suspendednegotiations after reaching an impasse. The FOP, along with theInternational Association of Chiefs of Police (IACP), were very earlypartners in this comprehensive effort. For the last year and a half, the FOPworked in good faith with Members of the House and Senate to enactmeaningful police reform, while protecting the due process rights of andprotections afforded to law enforcement officers.While we are unhappy that this work remains undone, the FOP is proud tohave preserved the existing doctrine of qualified immunity, the “objectivelyreasonable” standard established by Graham v. Connor, and the existinglanguage in 18 USC Section 242.There has been a lot of outrage expressed and premature statements madeabout the conduct of U.S. Border Patrol agents based solely on somephotographs. Serious allegations have been made and the matter is beinginvestigated. While the images have caused concern, we must rememberthat Border Patrol agents, just like any other American citizen, are entitledto due process and the presumption of innocence. Until the investigation is complete, and all the facts are known, we urge ourfellow citizens—and especially our elected officials—to refrain from a rushto judgement about the actions of the agents and the Border Patrol as awhole. LEGISLATIVE NEWS & ACTIVITYExecutive Director Jim Pasco gave numerous media interviewsin regard to criminal justice reform, the nationwide increase inviolent crime, and immigration issues.Bipartisan Police-Overhaul Talks End With No DealThe Fraternal Order of Police, the nation’s largest union of rank-and-file officers,over the summer worked with Mr. Booker and the International Association ofChiefs of Police on a draft proposal that contained items the union supported,including tightening recruiting standards and boosting training for policeexecutives. But the union opposed changes to qualified immunity and to thestandards under which officers are prosecuted for using force. THE U.S. HOUSE OF REPRESENTATIVESTHIS WEEK IN WASHINGTONThe House amended and passed H.R. 4350, the "NationalDefense Authorization Act," on a 316-113 vote. The legislation,which would authorize FY2022 appropriations for militaryactivities and programs of the U.S. Department of Defense(DoD), was transmitted to the Senate for further action.One of the numerous amendments that were considered wasoffered by Representative Henry "Hank" Johnson, Jr. (D-GA),which would have imposed restrictions on the 1033 program, asurplus equipment program administered by the DefenseLogistics Agency (DLA) and the Law Enforcement SupportOffice (LESO) within the DoD. The 1033 program allows Stateand local law enforcement agencies to obtain equipment theywould not otherwise be able to afford. THE U.S. HOUSE OF REPRESENTATIVES@GLFOP@FOPNATIONALNATIONAL FRATERNAL ORDER OF POLICEThe House considered and passed H.R. 5305, the "ExtendingGovernment Funding and Delivering Emergency AssistanceAct," on a 220-211 vote. The legislation, which was transmittedto the Senate for further action, would provide funding forFederal government operations and services through 3December 2021 at fiscal 2021 levels. In addition, the legislationwould suspend the statutory limit on Federal debt through 16December 2022 and also provide $6.3 billion in aid to helpresettle Afghan refugees in the United States.THIS WEEK IN WASHINGTONThe House considered and agreed to H.Con.Res. 41 by voicevote. This Concurrent Resolution, which was transmitted to theSenate for further consideration, authorizes the NationalFraternal Order of Police and its Auxiliary to host the 40thAnnual National Peace Officers Memorial Service (NPOMS) onthe Capitol grounds on 16 October 2021. The NPOMS will honorthe law enforcement officers who have died in the line of duty.

THE UNITED STATES SENATETHIS WEEK IN WASHINGTONThe Senate considered and confirmed the nomination ofRonald L. Davis to serve as Director of the U.S. MarshalsService (USMS) by voice vote.The FOP supported the nomination of Mr. Davis, as he hasbeen a reliable partner to the FOP over the years and strongadvocate for the men and women of law enforcement. Mr. Davis has always been willing to have an honest, opendialogue about the critical issues facing the law enforcementprofession. THE UNITED STATES SENATETHIS WEEK IN WASHINGTONThe Senate Committee on the Judiciary favorably reported S.2502, the "Kenneth P. Thompson Begin Again Act," to the fullSenate by voice vote. Under current law (18 U.SC. §3607), an individual can have asimple possession offense expunged from their criminal recordif they have no prior convictions, are placed on pre-judgementprobation (at the court’s discretion), have the proceedingsagainst them dismissed, and are 21 years of age or younger.This legislation, which the FOP supports, would amend thestatute and eliminate the age restriction while leaving fullyintact the other stringent requirements.The Senate Committee on Homeland Security andGovernmental Affairs held a hearing, entitled: "Threats to theHomeland: Evaluating the Landscape 20 Years After 9/11." Thewitnesses included Secretary Alejandro N. MANDATES FOR FEDERAL WORKERS Federal Government Mandates Vaccination for All Employees President Joseph R Biden Jr issued two new Executive Orders in early September The first requires all Federal agencies to implement programs requiring all executive branch employees to receive the COVID 19 vaccination subject to exceptions required by law The second Executive Order impacts Federal contractors and subcontractors The Safer Federal Workforce Task Force Task Force has issued guidance to all Federal agencies which implement both Executive Orders At this writing all Federal employees must be fully vaccinated by 22 November 2021 unless a reasonable accommodation is legally required because of a disability or because of a sincerely held religious belief practice or observance Individual agencies and their offices of general counsel will make these determinations The employing agency will require employees to provide documentation proving that they have been fully vaccinated This documentation will be treated like any other disclosed medical record and be subject to all Federal privacy rules and regulations Individual agencies will enforce the mandate and if an employee refuses to be fully vaccinated he or she may be subject to discipline up to and including termination We expect that there will be multiple legal challenges to the Executive Orders and to any executive actions taken at the agency level to implement them As the FOP noted in our recent policy statement the National FOP believes that the COVID 19 vaccines are safe and effective and we support their use to prevent infection However the National FOP asserts that whether or not to accept the vaccine is a personal decision that our members should make for themselves after consultation with their doctor or other medical professionals UPDATED POLICY STATEMENT COVID 19 VACCINES NATIONAL FRATERNAL ORDER OF POLICE GLFOP FOPNATIONAL
