Today, National President Yoes and members of the National Legislative staff joined a conference
call with Representative Garret N. Graves (R-LA), sponsor of H.R. 82, the "Social Security Fairness
Act," along with staff from the lead cosponsor Representative Abigail D. Spanberger’s (D-VA) office,
regarding the recent tabling of H.R. 82. Representative Graves specifically commended the FOP for
our prompt and candid response to this development on the Hill.
On Tuesday, November 5, in what appears to be a coordinated action by members of the House
Freedom Caucus, Representative Andrew P. Harris, MD (R-MD), the current Freedom Caucus
Chairman, collaborated with Representative Robert G. Good (R-VA), the former Chairman of the
Freedom Caucus, to table H.R. 82. This maneuver was a clear violation of the established rules and
practices of the House.
A review of the session’s proceedings (start at the 7 minute mark) shows that Representative Harris
was explicitly advised by a member of the House Parliamentarian’s office that he could not recognize
Mr. Good or entertain a unanimous consent request in a pro forma session without the prior consent
of the committee leadership, the Speaker of the House, and the Minority Leader. Despite lacking such
consent, Representative Harris allowed H.R. 82 to be tabled, which effectively set a new and
potentially harmful precedent.
House leadership believes this violation threatens the integrity of pro forma sessions by potentially
enabling legislative actions with minimal presence on the floor. They are committed to reversing this
precedent and, in so doing, putting H.R. 82 back on the path to getting a vote on the House floor in
one way or another as early as this week.
We NEED FOP members to take IMMEDIATE ACTION and call, fax, and email their House
Representatives and urge them to vote YES on H.R. 82, the “Social Security Fairness Act.”
