The FOP strongly opposes the amendment introduced by Rand H. Paul (R-KY), the
“Fourth Amendment is Not for Sale Act,” to H.R. 7888, the “Reforming Intelligence and
Securing America Act.”
We are asking you to TAKE ACTION and tell your Senators to vote against this
amendment.
The amendment, like the bill the House adopted earlier this week, would destroy the
basic ability of law enforcement to conduct investigations into violent crimes like
murder, kidnapping, terrorism, and other serious threats. The bill does this by prohibiting
law enforcement from accessing commercially-available information about customers or
subscribers from third-party providers—data which is widely available for non-public
safety purposes.
Access to this data is critical because it allows law enforcement to identify and pursue
leads—to “connect the dots” as they investigate serious crimes. These leads are used to
gather evidence and establish probable cause for an arrest and prosecution. By
prohibiting access to this commercially available data, Congress would be tying the
hands of law enforcement and greatly increasing the time it takes to conduct successful
investigations into serious crimes.

The bipartisan House Law Enforcement Caucus also opposed the bill on the House floor.

Earlier this week, the House Committee on Ways and Means Subcommittee on
Social Security held a hearing on the Windfall Elimination Provision and the
Government Pension Offset. You can watch the hearing and read the testimony of

The House considered and passed H.R. 4639, the “4th Amendment is Not For Sale
Act,” on a 219-199 vote. The bill, which the FOP opposes, was transmitted to the
Senate for further action.
